Terms of service

Perchpush is operated by Neptechpal Pvt. Ltd., Nepal (“we”). By creating an account or using Perchpush you (“the customer”) agree to these terms. If you use Perchpush for a company, you confirm you may bind it.

1. Accounts

You sign in with Google or with a link we email you. Keep access to that email account secure; anything done through your sign-in is your responsibility. The owner of an app is the billing account for it and decides who else on the team can access it.

2. Your responsibilities

You must have your users’ consent to message them, follow Apple, Google, browser and carrier rules and the anti-spam laws that apply to you, and not send spam, illegal content, malware or messages to people who opted out. You are responsible for the credentials (Firebase, APNs, SMTP, SMS, AI keys) you connect and for the content you send.

3. Acceptable use

Do not try to access other customers’ data, probe or overload our systems, register fake devices, use tracking links for phishing or misleading redirects, or resell Perchpush without our written agreement. We may remove content or suspend an account that breaks these rules, and will tell you why unless the law or an ongoing investigation prevents it.

4. Plans and payments

• Starter is free. Growth and Business are paid plans with the limits shown on the pricing and billing pages.
• Prepaid: you can pay for 1 to 12 months in advance. The plan stays active until the paid-until date and then returns to Starter unless you renew. We email a reminder before it ends.
• Subscription: you can instead subscribe monthly by card through Stripe. It renews automatically each month until you cancel. You can cancel at any time in Billing; cancellation takes effect at the end of the current paid period and you keep the plan until then.
• Plan changes: when a subscription moves between Growth and Business mid-period, Stripe prorates the difference — you are charged or credited for the unused part of the current period.
• Limits: usage beyond your plan’s monthly ceiling is refused, not billed. There are no surprise overage charges.
• Prices are in US dollars and exclude any taxes you must pay locally. Payments are not refunded except where the law requires or we agree in writing.
• If a subscription payment fails, Stripe retries it; if it still fails the plan returns to Starter. Your data is kept.

5. Your data

You own the data you and your apps send to Perchpush. We use it only to provide the service, as described in our privacy policy. For end-user personal data we act as your processor under the Data Processing Agreement, which forms part of these terms. You can export or delete your data at any time from the dashboard.

6. Availability and changes

We work to keep the service available (see the status page) but provide it “as is”, without warranties, and do not guarantee delivery by Apple, Google, browsers, mail servers or carriers. We may improve or change features; we will give 30 days’ notice by email before removing a feature that paid plans depend on.

7. Liability

Neither side is liable for indirect or consequential losses such as lost profits or data. Our total liability for any claim is limited to the fees you paid us in the three months before it arose. Nothing here limits liability that cannot be limited by law.

8. Termination

You can stop using Perchpush and delete your apps and account at any time. We may suspend or close accounts that break these terms or do not pay. After closure we delete your app data as described in the privacy policy, except records we must keep by law.

9. Changes to these terms

We will post changes here and email account owners at least 14 days before material changes take effect. Continuing to use Perchpush after that means you accept them.

10. Law

These terms are governed by the laws of Nepal, and disputes go to the courts of Kathmandu, unless the law of your country gives you a right to bring them at home.
